The Option Of Last Resort

Most people choose to live independently for as long as possible. It’s natural – independence and privacy are the hallmarks of adulthood. Occasionally, however, a person decides to continue living on his own, even when those around him agree that it’s no longer safe.
If your loved one insists he is fine alone, even when you know he’s not, and if your best efforts to reason with and persuade your loved one have failed, your only legal option is for someone to petition a court to be declared that person’s guardian. A guardian can make decisions about appropriate living situations for his or her “ward,” even when the ward disagrees.

Guardianship is an option of last resort. Part of the process of becoming a guardian is proving that the person you want to be guardian of is legally incapacitated – [legal definition]. In some cases, however, it’s the only way to make sure a loved one gets the care he desperately needs.
